Atiku ask court to compel INEC to release election materials for inspection

The Peoples Democratic Party and its presidential candidate, Alhaji Atiku Abubakar, on Tuesday, filed an application seeking an order compelling the Independent National Electoral Commission  (INEC) to allow it to inspect materials used for the conduct of the general election.

The petitioners, through their lawyers, Chief Chris Uche (SAN), filed the ex parte application before the Presidential Election Petitions Tribunal located on the premises of the Abuja Division of the Court of Appeal.

They are through their application seeking the tribunal's order granting them permission to inspect the Voters Register, Smart Card Reader Machines, ballot papers and other documents used for the conduct of the poll.

Inspection of election materials usually precedes the filing of an election petition.

INEC, President Muhammadu Buhari and the All Progressives Congress, were joined as the first to the third respondents in the motion filed by PDP and Atiku.

As Atiku Takes Buhari To Court Over Rigging, Another Presidential Candidate Drags Buhari and Atiku To Court For Allegedly Spending Over N1b On Campaigns

The presidential candidate of the National Rescue Movement (NRM), Mr Usman Ibrahim-Alhaji has dragged President Muhammadu Buhari and the presidential candidate of the Peoples Democratic Party, Atiku Abubakar to court for allegedly spending more than the one billion naira as law requires on their election campaigns.

Usman prayed the court to invoke Section 91(2) of the Electoral Act, 2010 to nullify the participation of Buhari and Atiku in the February 23rd presidential election for allegedly violating the Electoral Act 2010.

The plaintiff through his counsel, Mr Ezekiel Ofou is praying the court to set aside the participation of Buhari and Atiku on the grounds that they spent over N1 billion each as campaign expenses.

He alleged that by spending over N1 billion each, Buhari and Atiku violated the electoral law and are liable to be removed as contestants in the election.

When the matter came up on Tuesday, Ofou told the court that he found it extremely difficult to serve the court papers to Buhari and Atiku, who were the main defendants in the suit because of security operatives around them.

Ofou then moved an ex parte motion in which he prayed the court for an order of substituted service on the two major defendants.

He based his demand for the ex parte motion on Order 6 Rule 5 of the Federal High Court Practice Direction, which would allow him to serve Buhari and Atiku through the legal departments of their respective parties.

The trial judge, Justice Ahmed Mohammed in a short ruling, granted the application for substituted service.

Buhari and Atiku are to be served through the legal departments of the All Progressives Congres and the PDP respectively.

The APC, PDP and the Independent National Electoral Commission are also named as defendants in the suit.

Justice Mohammed adjourned the matter until March 26 for mention.
